Substantive Criminal Protection of the National identification Num-ber in Libyan Legislation

Abstract:

The national identification number system represents an integrated framework whose purpose is to preserve the national identity of a given community. As such, it constitutes a manifestation of state sovereignty; consequently, any infringement upon it exposes national security to danger. From this standpoint arises the necessity of providing criminal protection for the national identification number against any form of assault.Accordingly, the Libyan legislator has regulated the national identification number system through a special law, namely Law No. (8) of 2014. This law also incorporated provisions of the Penal Code with regard to offenses involving the forgery of the national identification number and the use of a forged national identification number.However, the recent spread of forgery related to the national identification number prompts questions regarding the adequacy of the criminal policy adopted by the Libyan legislator to protect the national identification number, and the extent to which it requires development and amendment.
